At Lawpoint, we offer fixed-fee pricing on Wills, Power of Attorney and Enduring Guardianships. Once you contact us and we understand your needs, we’ll share the fixed fee upfront.

Once your Will is complete, you have the option of keeping it in our Safe Custody at no extra cost. In this case, make sure your family knows that we are holding your Will. We will only release it once we have received a death certificate.

Alternatively, you may store your will in a safe and secure place with your other important papers.

What is of utmost importance is that it securely stored and your executor knows its location so that it can be retrieved when needed.

Contesting a Will involves you contesting the adequacy of what has been left to you in a Will. Challenging a Will is different. It means that you are challenging the validity of the Will itself. This can be for a number of reasons including fraud, undue influence on the will maker, forgery or, more commonly, that the will maker lacked capacity and did not understand the effect of the Will when it was signed.

These situations require careful planning to ensure your wishes are legally documented and your estate is protected. Our team has extensive experience in structuring even the most complex of Wills. 

Yes. If your circumstances have changed such as a new relationship, child, property, or business, it’s important to update your Will to reflect your current situation.

It is also essential to update your will if you marry or divorce, as in NSW, marriage invalidates a Will and divorce invalidates certain parts of a Will.

Yes, each person needs their own Will. Even if your wishes are similar, separate Wills ensure your individual assets and intentions are clearly documented and legally valid.

It usually takes 1–2 weeks to finalise a Will, depending on complexity. Simple Wills can be prepared faster, especially if your instructions are clear and complete or if your situation is urgent.

We will be upfront with you about timeframes and take into consideration your personal needs.

There are so many factors involved in determining this. Once we understand the nature of your case, we will put together a costs agreement that estimates what your case may cost through to a hearing. Remember, many matters settle outside of court and so the full fee estimate may never be realised. However, we will give you a best and worst case scenario in the interest of full transparency.
