Total And Permanent Disability Claims
Home / Compensation Solicitors / Total and permanent disability claims
Most people have total and permanent disability (TPD) insurance cover as an additional benefit of their superannuation. You might also have TPD cover as part of a stand-alone income protection or life insurance policy.
What is a total and permanent disability claim?
Are you wondering if you have a claim for total and permanent disablement arising from an injury or illness you have suffered?
If you have TPD cover, you are eligible to make a TPD compensation claim if you can establish that you are no longer able to work in your usual job or another job that is within your education, training or experience due to an injury or illness. Each policy has different definitions which must be satisfied, so it is important to seek legal advice as early as possible.
Usually, you do not have to prove that you are totally unfit for all work, only that you are no longer fit to work in a role consistent with your education, training and experience.
Unlike workers compensation claims, your illness or injury does not need to be caused by your employment. Any injury or illness regardless of how it was caused can be grounds for a total and permanent disability claim.
Is my claim for total and permanent disablement different to income protection?
Making an income protection claim is different to total and permanent disability claim. With income protection, you may be eligible to receive a payment each month whilst you are unable to work due to an injury or illness. These payments are temporary and are only made until you are able to return to work or until the benefit period stated in the policy expires.
The amount that is paid varies depending on the policy and the level of cover that you have, but usually these benefits are paid at around 75% of the wages you were earning immediately prior to your injury or illness.
It is possible to have both income protection insurance and total and permanent disability insurance under the same or different policies.
How much can I claim?
The amount of TPD compensation you can claim will depend on the specific cover provided for by your policy. Typically, TPD benefits will be paid as a lump sum and the amount of compensation paid can be substantial.
Our lawyers will help you understand whether you can make a claim for total and permanent disablement by carefully understanding your personal circumstances and reviewing your specific insurance policy. We will then make a claim on your behalf to ensure that you claim the full amount of your entitlements.
In some instances, insurers can reject valid claims. If you have already lodged a TPD claim and it has been rejected, contact our total and permanent disability claim lawyers who will review your claim
